All content is protected by UK copyright law and international copyright treaties.

Downloadable resources

Downloadable resources (capability decks, audit tool reports, white papers) are provided for your personal use in evaluating our services. You may download and retain these documents for that purpose. Republication, distribution, or commercial reuse of these materials is prohibited without written permission.

5. Downloadable resources

Capability decks, audit reports, and white papers

Downloadable resources and tools are provided to help you understand our approach and capabilities. They are supplied "as is" without warranty of accuracy, completeness, or fitness for any particular purpose.

These documents reflect best practice, methodologies, and case examples based on work conducted at the time of publication. Circumstances, industry conditions, tool specifications, and technology standards change. You should not rely on these documents as current advice without seeking confirmation from Indivillage that they remain applicable to your specific situation.

Audit tool reports

Any automated audit tool results (e.g. website health checks, marketing audits) are generated based on data you provide and publicly available information. Results are indicative only and are not a substitute for a professional consultation. Indivillage does not guarantee the accuracy or completeness of tool outputs and accepts no liability for decisions made in reliance on audit results alone.

6. Information accuracy and disclaimers

Best efforts

We make reasonable efforts to ensure that information on the Website is accurate, current, and complete at the time of publication. However, we do not guarantee accuracy or completeness, and information may become outdated without notice.

Case studies and client metrics

Case studies describe work we have undertaken for specific clients under particular circumstances. Results, metrics, timelines, and outcomes reflect those specific engagements and are not guaranteed or typical for all clients. Variables such as client investment, market conditions, implementation discipline, and external factors materially affect outcomes. You should not assume equivalent results for your own situation without detailed discussion with our team.

No warranty on outcomes

The Website describes our methodologies, experience, and past work. It does not constitute a warranty of future results, improved performance, revenue growth, or any other business outcome. Success in marketing, brand development, and digital transformation depends on many factors beyond our control, including your market, competitors, execution, and broader economic conditions.

Service terms are separate

Any warranties, service levels, liability limits, and outcome commitments specific to our services are set out in your formal services agreement or master service agreement. These Website terms do not modify those contractual commitments in any way.

7. Limitation of liability

What we are not liable for

To the fullest extent permitted by English law, Indivillage and its officers, employees, and agents shall not be liable for:

  • Loss of profits, revenue, business opportunity, anticipated savings, or goodwill

  • Indirect, consequential, special, or punitive damages
  • Any loss or damage arising from use of, or inability to use, the Website or any content on it
  • Interruption, delay, or unavailability of the Website
  • Third-party actions, including hacking, viruses, or malware
  • Reliance on information, case studies, or metrics published on the Website

This limitation applies even if Indivillage has been advised of the possibility of such loss.

What cannot be limited

Nothing in these terms limits or excludes:

  • Liability for death or personal injury caused by negligence
  • Liability for fraud or fraudulent misrepresentation
  • Liability for breach of any statutory right or implied term that cannot be excluded or limited under English law (including the Consumer Rights Act 2015, where applicable)
  • Any other liability that cannot be lawfully limited

Liability cap

Subject to the carve-outs above, Indivillage's total liability to you in connection with the Website shall not exceed £100. This cap reflects the non-transactional nature of the Website; commercial engagements are governed by a separate signed agreement.

8. Third-party links

The Website contains links to third-party websites, including Machani Group companies, partners, and external resources. We do not endorse, warrant, or assume responsibility for the content, accuracy, legality, or policies of any linked site.

Your use of third-party websites is at your own risk and is governed by their own terms and conditions. We recommend reviewing the terms and privacy policies of any third-party site before providing personal information or completing transactions.

We are not responsible for any loss, damage, or dispute arising from your interaction with linked websites.

10. Changes to these terms

We may update these terms from time to time to reflect changes in our business, legal requirements, or Website features. Any changes will be posted on this page, and the "last-updated" date will be revised accordingly.

Your continued use of the Website after changes are posted constitutes acceptance of the updated terms. If you do not agree with changes, you must stop using the Website. We recommend reviewing these terms periodically.

For material changes that substantially restrict your rights, we will use reasonable efforts to provide prior notice where practicable, but we are not obliged to do so.

11. Governing law and jurisdiction

These terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

You irrevocably submit to the exclusive jurisdiction of the courts of England and Wales for any dispute arising from or relating to these terms or your use of the Website. Both you and Indivillage agree that the courts of England and Wales are the appropriate forum for resolution of any such dispute.

Nothing in this clause prevents either party from applying for interim relief in any other court of competent jurisdiction.
